Legal injunctions 

A legal injunction is a court order that requires a party to take certain steps, or prevents them from carrying out certain activities.  There are many commercial scenarios that may lead to an injunction, most commonly where irreparable damage can be caused, if not addressed. 

Injunctions are more often than not an emergency remedy, and any delays in obtaining such an order can have serious consequences. If you believe you are entitled to an injunction, it is advisable to contact a specialist solicitor immediately.  

Types of injunction 

  • Search Order: Requires the defendant to allow the claimant to search for evidence likely to be disposed of on notification of a claim.
  • Freezing Order: Stops one party from disposing of or dealing with assets until a judgement has been obtained and enforced.
  • Disclosure order: Requires a party to search for documents that are relevant to the dispute with the other party prior to judgement and sometimes prior to proceedings.

When can an injunction be used?

There are many situations when an injunction can be applied for, such as:

  • To avoid an ongoing breach of contract
  • To stop dealings with particular customers or suppliers
  • To prevent a breach of confidence
  • To halt the publication of defamatory information
