What happens to my compensation claim if I wasn’t wearing my seatbelt?
If you were injured in a road accident that wasn’t your fault, but you weren’t wearing a seatbelt, it will almost certainly affect your personal injury compensation claim.
The law on this is very clear. If you are not wearing your seatbelt when you are injured, the amount of compensation you receive will be reduced:
- By 25% if your injuries would have been entirely avoided if you had been wearing a seatbelt
- By 15% if the seatbelt would have reduced the severity of your injuries
If the failure to wear your seatbelt made no different to the injuries you sustained, the amount of compensation you received will not be reduced.
