When can I make a discrimination at work claim?

Under the 2010 Equality Act, it is illegal for a person to be discriminated against in the workplace on the basis of any of the following: 

  • Age
  • Gender reassignment status
  • Being married or in a civil partnership
  • Being pregnant or on maternity leave
  • Disability
  • Race, including colour, nationality, ethnic or national origin
  • Religion or beliefs
  • Sex
  • Sexual orientation

Workplace discrimination can take a number of forms, and you may wish to pursue legal action if you have been subjected to any of the following: 

  • You are being paid less than others doing the same work for discriminatory reasons
  • You are forced to follow different rules from everyone else due to an aspect of your identity
  • You have been unfairly dismissed or forced out of your job due to discrimination
  • You have been targeted for workplace bullying and harassment

What can I do if I am being discriminated against at work?

If you feel you have been unlawfully discriminated against at work, you should take the following steps: 

  • Check whether the mistreatment you have experienced is specifically protected against by anti-workplace discrimination laws
  • Gather evidence to back up your complaint
  • Make an informal complaint to your employer to explain your situation, giving them an opportunity to resolve the matter internally
  • If this does not resolve the situation, lodge a formal complaint through the company’s grievance procedures
  • If the problem remains unresolved, you can take legal action at an employment tribunal. To do this, you will first need to speak to the Advisory, Conciliation and Arbitration Service (ACAS) to see if a solution can be found through its Early Conciliation process; if not, you will be able to proceed to a court hearing 

If you intend to launch employment tribunal proceedings for a discrimination case, you must normally do so within three months of the initial incident (or three months from the last in a series of incidents) about which you are complaining.
