Power Of Attorney Fee Refund Scheme

A scheme has been set up from Thursday 1st February 2018 to refund those who may have paid more than they should when applying to register a Lasting Power of Attorney or an Enduring Power of Attorney.

The scheme has been set up by the Ministry of Justice to allow those eligible to claim a partial refund on application fees paid between 1 April 2013 and 31 March 2017.

The Ministry of Justice recently lowered the registration fee in April 2017 to £82.00 per Power of Attorney. This scheme will now allow those who previously had paid a higher fee to register their Power of Attorney to claim a partial refund.

HOW MUCH WILL I BE REFUNDED?

The refund will vary depending on the fees set at the time you registered the Power of Attorney, whether the donor paid the full fee, a discounted fee (known as a remission) or a repeat fee.

HOW DO I APPLY FOR THE REFUND?

You will be able to apply online at https://www.gov.uk/power-of-attorney-refund

Either yourself or your Attorney will be able to claim for the refund and this can be done either online or by calling the Office of the Public Guardian refund helpline on 0300 456 0300.
