Employment Tribunal Fees Unlawful

The Supreme Court has decided that Employment Tribunal fees, which were introduced in 2013 and which lead to a 70% drop in claims, are unlawful. 

Importantly the Court indicated that employment tribunal cases are important for society as a whole (not just for those individuals involved) and that as fees prevented access to justice they were unlawful.

What’s not clear is what happens now. All fees which have been paid since they were introduced will have to be repaid by the Lord Chancellor’s Department but it’s unlikely that fees will be scrapped altogether going forward –it’s probable that the Government will bring in fresh fees after a no doubt ridiculously brief consultation period.
