We understand that a bereavement can be a distressing experience. You may not wish to face the legal formalities of administering the estate of a loved one on your own.
We provide a personal and friendly service. We like to keep things simple and will use clear, plain and jargon free language where ever possible. We are here to help during what may be a difficult and stressful time, providing you with the support you need.
If you are responsible for administering an estate (either as an Executor or Administrator) you have significant duties and responsibilities. You have a personal liability to both beneficiaries and creditors of the estate and must account for all actions taken during the estate administration.
Dealing with the assets and liabilities of a deceased person can be time consuming and complicated. You must address certain issues, such as ensuring all debts are paid, dealing with any claims against the estate and finalising any tax affairs before you distribute monies to the beneficiaries.
As an Executor or Administrator you are under a duty to maximise the value of the estate for the beneficiaries and must act in a prudent and timely fashion. Failure to do so may give the beneficiaries of the estate grounds to claim compensation from you personally.
In addition, claims against estates are becoming more common and it falls to you as the Executor/Administrator to defend or settle any such claim before the estate can be finalised.
As you can see, administering an estate is a complex and lengthy process which is potentially fraught with problems for which you will be personally liable. All members of the Private Client Team at Clough and Willis are all specialist solicitors who have years of experience in dealing with the administration of estates. All our solicitors are members of the Society of Trust and Estate Practitioners (STEP) and both Sally and Howard are accredited Trust and Estate Practitioners (TEP).
Your matter will be handled from start to finish by the same solicitor that you meet initially. We do not operate in a call centre.....you will always speak to one of the team.
We will be able to confirm a full estimate of our costs at the outset and deal with it on a fixed fee basis if you prefer.
For an informal, no obligation discussion to consider your personal requirements please contact a member of the Private Client team.
