What is Unfair Dismissal?
Unfair dismissal is a statutory right that enables employees to make a claim if they believe they have been unfairly dismissed or made redundant. This often results in an Employment Tribunal hearing, which will decide the outcome of your claim.
Unfair dismissal claims often occur on the grounds of:
• Discrimination - on the basis of gender, race, age, disability, religion or sexual orientation
• Unfair redundancy
• Incorrect dismissal process
• Maternity or paternity leave
• Whistle blowing
• Grievance hearings
• Refusing to do shop or betting work on a Sunday
• A minimum notice period
• Time off for dependants
Can I Make an Unfair Dismissal Claim?
Unfair dismissal and redundancy claims can only be pursued if you have been in your role for at least 12 months. If you are unsure whether you are eligible to make a claim, the employment solicitors at Clough & Willis will assess your case and identify the next steps to take.
