Working Time Regulations and holidays
What should be a fairly simple matter - that is, the taking of holidays - has become far from that under the Working Time Regulations. There have been many cases in this area, most recently concerning holidays during sickness absence. Employers and HR professionals cannot be blamed for being confused as to what holidays workers are entitled to and when they can be taken. When a worker becomes sick during annual leave or is sick before and then during a period of requested annual leave, what is the worker entitled to? Is a worker entitled to annual leave during ordinary and/or additional maternity leave? Does a worker have to be paid when on a period of annual leave or can holiday pay be incorporated into a workers wages? There are also issues concerning the conditions required for refusing annual leave and when workers can be required to take annual leave.
Andrew will address the above matters and update attendees as to the current position concerning annual leave taking into account all the recent case law.
