What is a Commercial lease?

A commercial lease is a binding legal contract that sets out the terms and conditions of the tenancy agreement for a commercial property.

The contract helps to outline and define the obligations and rights of both the landlord and the tenant in the commercial lease agreement, and is often complex, covering a range of topics, such as:

  • The type of property being let;
  • The lease term of the tenancy and whether the tenancy is for a fixed term or renews periodically;
  • The address of the property;
  • The amount of rent payable;
  • When the rent should be paid;
  • The type of business that is allowed to be conducted on the premises;
  • Ownership of any leasehold improvements;
  • Security and damage deposits;
  • Details of whether the tenant can assign or sublet the property;
  • Arrangements for the renewal of the lease;
  • Notice periods for terminating of the tenancy.

Because of their complexity, commercial leases are usually drawn up by legal experts advising the landlord - with a first draft forming the basis of a discussion and negotiation between the landlord and the tenant.

Commercial lease services for landlords

We act for business owners with commercial premises or landlords with a portfolio of commercial properties that require solicitors for management issues.

It is vital to the investment that the terms of the lease are as tight as possible so as to protect the investment and revenue stream of the premises.

We can tailor the leases to suit the required usage, whether that is for industrial, leisure, retail, office and mixed use.

Our team of specialist solicitors can also advise on the preparation of new leases, deal with renewal of existing leases and review the suitability of existing leases in the light of any title, environmental or planning issues and any changes in the law.

Commercial lease services for tenants

If you are a tenant, we can advise on the terms and implications of a lease presented to you, and can help regarding any of the following points:

  • Your business plan
  • The nature of your business
  • Potential expansion
  • Proposed use of the premises
  • Any alterations required

We will ensure that you are aware of the various terms in the commercial lease, and advise on the suitability of entering into the lease. In certain situations we can offer a cost effective fixed fee package - for more information, visit this page

Our aim in preparing or negotiating a tenancy is to tailor the lease agreement or action required to suit your business. That means we have your best interests and business requirements at the forefront of our minds at all times.
