



Restrictive covenants can be used to stop employees, following termination of employment, from acting in competition with your business, from taking your clients and from poaching your employees.
Such clauses are notoriously difficult to enforce. However, in recent times the courts have appeared to be more willing to enforce such provisions.
The key to the enforceability of such clauses is in the drafting. The clauses need to ensure that they go no further than what is adequate to protect a legitimate business interest.
