



Such packages obviously assist in trying to ensure a positive, motivated, committed and loyal workforce. They are also extremely helpful in enabling the business to succeed - for example well thought out commission schemes enable employees to earn a high wage but only if they are equally contributing to the profit of the business.
However, all the advantages of such packages can be eroded by poor drafting which can also lead to expensive claims to the Courts and the Employment Tribunal.
What you may consider to be a discretionary scheme may not be discretionary at all. Furthermore, if it is a discretionary scheme, how is that discretion being exercised and is that a lawful exercise of discretion?
Is the scheme being operated in a discriminatory manner? Should employees on maternity leave have access to the scheme? Are agency workers entitled to participate in the scheme? These are just some of the questions that need to be considered before a scheme is drafted and/or implemented.
Ensuring from the outset that your scheme is drafted in a manner that reflects what it is intended to achieve and is lawful in its operation, enables you to benefit from the advantages intended.
