Shareholder disputes
The commercial dispute team acted for a shareholder of a commercial vehicle repair company under s994 Companies Act 2006 Petitions of the Companies Act (relief from unfair prejudice to a shareholder). The case was successfully settled by agreement with our client taking control of the company.

Defamation
Defamation is the catch all term for libel (a published defamation) and slander (generally spoken  words which are not recorded). Broadcasts, plays put on in public and publications on the internet  are libels.

In business terms the most obvious defamation is to suggest that a competitor is insolvent - or similar words eg "gone bust”, "gone under”.

Commercial injunction
The team successfully sought and obtained a commercial injunction against a 3rd party for the return of a commercial plant which was duly recovered.

Property Disputes
The team of property dispute specialists recently acted for a limited company in its relocation and subsequent re-development of the existing business site and successfully resolved a planning permission dispute, saving the company in excess of £200,000.

Derivative action
The commercial dispute resolution department pursued a derivative action bought by a shareholder, on behalf of a company, to protect its assets / intellectual property.

Partnership disputes
The commercial dispute resolution solicitors at Clough & Willis recently advised a partner withdrawing from the partnership, advising on the meaning / implications of deed of partnership. The case was further complicated by the partner's position as company director of associated companies.

The commercial team defended a claim brought by an international shoe fashion brand for breach of copyright.
